Terms of Service

1. Sovereign Mobile Software License

All mobile applications distributed on the Google Play Store under developer Akash Kailashiya (including PicToPDF, CWealth, and Bulk Curve) are provided as downloadable digital utilities:

• Permitted Use: You are granted a personal, revocable, non-exclusive, non-transferable license to download and run the software on personal Android devices for lawful purposes.
• Zero Cloud Reliance: Because apps operate 100% locally on-device, you remain solely responsible for backing up your local files, databases, and generated PDFs.
• Restrictions: You may not reverse-engineer, decompile, redistribute repackaged APKs, or attempt to monetize cracked builds of proprietary features.

2. Bespoke Client Consulting & Development Engagements

For custom Android engineering, full-stack web platforms, or technical consulting agreements:

• Scope & Quotation: All work is governed by a mutually agreed project proposal specifying deliverables, budget tiers, and target milestones.
• Intellectual Property Ownership: Upon complete settlement of agreed project fees, 100% full intellectual property, source code, repositories, and custom assets are transferred unconditionally to the client.
• Review & Acceptance: Clients have a 14-day acceptance review window following each milestone delivery to report bugs or alignment adjustments within the agreed scope.

3. Homora Store & Physical 3D Fabrication Terms

For all physical 3D desk sculptures, lithophane lamps, and functional hardware prototypes:

• Manufacturing Characteristics: 3D printed products are manufactured using additive manufacturing (FDM/CoreXY). Micro-layer lines (typically 0.08mm to 0.2mm) are inherent natural characteristics of additive manufacturing and are not classified as defects.
• Custom Lithophane Photo Requirements: Personalized lithophanes require high-resolution image uploads with distinct contrast. The quality of the final illuminated lithophane directly corresponds to image clarity provided by the customer.
• Shipping & Transit: Orders are packaged in protective impact-resistant packaging and dispatched via insured pan-India couriers. Tracking codes are issued upon dispatch.
• Damages in Transit: If a package arrives physically broken during courier handling, customers must record a continuous unboxing video upon opening. We guarantee a 100% free replacement reprint upon verifying valid unboxing evidence within 48 hours of delivery.

4. Intellectual Property & Trademarks

All brand assets, studio logos, original CAD sculpture designs, YouTube video publications, technical field notes, and digital documentation appearing on this website are the proprietary property of Akash Kailashiya, protected under Indian and international copyright laws. Unauthorized reproduction or scraping for commercial distribution is strictly prohibited.

5. Warranty Disclaimer & Limitation of Liability

Except as expressly stated in a bespoke client contract:

• All software utilities, educational tutorials, and digital downloads are provided "as is" and "as available" without warranty of any kind.
• Akash Kailashiya Studio shall not be liable for any indirect, incidental, or consequential damages resulting from hardware misuse, data loss on unbacked personal devices, or third-party platform alterations (such as Google Play operating system updates).

6. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these Terms or studio operations shall be subject to the exclusive jurisdiction of the competent courts in Madhya Pradesh, India.
